1.1 Scope

These terms apply to all orders placed via this online shop.
We offer two types of products:

• Digital downloads (photography files)
• Print-on-demand products (wall art, posters, fine art prints), produced and shipped individually via our production partner Gelato.

1.3 Prices & Payment

All prices include statutory VAT where applicable. Payment is due immediately at checkout.

1.4 Delivery Times

– Digital downloads: immediately after payment
– Print products: 5–10 business days (depending on region)

1.5 Liability

Statutory warranty rights apply. For defective or damaged goods, please see section 2.

2. Right of Withdrawal & Returns

2.1 Digital Downloads

By purchasing a digital product, you expressly consent to the immediate execution of the contract. You acknowledge that your statutory right of withdrawal expires once the download has started.

Checkout notice:
At checkout, you must confirm:
“I expressly agree that the execution of the contract begins immediately and I lose my right of withdrawal once the download has started.”

2.2 Print-on-Demand Products

All prints are custom-made to your order and therefore excluded from the statutory right of withdrawal (Art. 16(c) EU Consumer Rights Directive).

2.3 Returns for Defects

If your item is defective, damaged, or incorrect, you may request a replacement or refund. Please email [your@email.com] within 14 days of receipt and include:

• Your order number
• Photos of the product and packaging
• Short description of the issue

We will handle the matter with Gelato.

3. Payment & Delivery

3.1 Payment Methods

3.2 Delivery

– Digital downloads: immediate download link after payment
– Prints: produced by Gelato and shipped directly to you

3.3 Shipping Costs

Shown during checkout. Customs or import fees (if any) must be paid by the customer.

4. Licensing Terms

4.1 General

All files remain the intellectual property of the photographer. Purchasing a file grants a simple, non-transferable right of use.

4.2 Private License (Default)

Allowed:

• Printing for personal wall art
• Use on private websites or social media (with credit)

Not allowed:

• Commercial use
• Resale, redistribution, or sharing
• Uploading to image-sharing platforms

4.3 Commercial License

For editorial, advertising, or business use, a separate license agreement is required. Please contact us before purchase.

5. Privacy & Data Sharing

5.1 Order Fulfilment

To fulfil your order, necessary customer data is shared with Gelato (production & shipping partner).

5.2 Legal Basis

The legal basis is Art. 6(1)(b) GDPR (contract performance). Gelato processes your data solely to deliver your order.
