Terms, Withdrawal & Licensing

1. Terms & Conditions

1.1 Scope

These terms apply to all orders placed via my online shop for digital fine art photography by consumers and business clients.

1.3 Subject

High-resolution photo files are sold for private or commercial use in accordance with the selected license terms.

1.4 Contract Formation

By placing your order, you make a binding offer. The contract is formed once you receive the order confirmation.

1.5 Prices & Payment

All prices are final. Payment can be made by bank transfer (prepayment), PayPal, or credit card.

1.6 Licensing

Upon purchase, you receive a non-exclusive, non-transferable right of use as specified in the chosen license. See Licensing Terms.

1.7 Liability

Statutory warranty rights apply. Liability for slight negligence is excluded unless essential contractual obligations are affected.

2. Right of Withdrawal

In accordance with EU consumer protection law, the statutory right of withdrawal does not apply to contracts for the supply of digital content (such as image files) that is not delivered on a physical medium if the performance has begun with the consumer’s prior express consent and acknowledgment that they thereby lose their right of withdrawal.
 
By placing an order, you expressly agree that the execution of the contract will begin before the withdrawal period has expired and you confirm that you are aware that this results in the loss of your statutory right of withdrawal.

3.1 Delivery

Delivery is exclusively digital and made via download link immediately after successful payment.

3.2 Shipping Costs

There are no shipping costs.

4. Image Licensing Terms

4.1 General

By purchasing an image file, you acquire a simple, non-transferable right of use for the respective work by Raimund Verspohl-Spring. The copyright remains fully with the photographer.

4.2 Private License (Standard License)

This license allows use for private, non-commercial purposes, e.g.:

  • Printing for personal use (e.g. wall art)
  • Use on personal websites or social media (with name credit)

All image files offered here are for personal use only – for example, to create printed formats like canvas, posters, or aluminum-mounted prints.

Not permitted:
  • Commercial use (e.g. advertising, packaging)
  • Redistribution, resale, renting or publishing the file
  • Uploading to image sharing platforms
4.3 Commercial License (available upon request)

For editorial, advertising, or business use, a separate commercial license is required. Please contact me prior to purchase.

4.44 Technical note

All files contain embedded metadata with copyright and author information.

4.5 Copyright enforcement

Any unauthorized use, reproduction, or distribution will be prosecuted under copyright law.
